Hank Langstroth Acting Chairman, Keevin Geller, Meredith deCarbonnel, and Elizabeth McGrath were the members present. The Conservation Administrator, Greg Meister, was also present

7:45 p.m., A Notice of Intent Public Hearing filed by AT & T for the proposed installation
of a cell tower, access road, and associated utilities at 68 Mohawk Street, DEP # SE-280-0516:

Present:   Representatives from AT & T - Dan Bilezikian, Eamon Kernan, P.E., and Attorney Ed Pare
                Wetland Consultant Leo Garneau - Northeastern Consulting Forestry Services   
                 Abutters/Interested Persons were also present. See attached list.

Attorney Ed Pare appeared before the Commission to represent the Applicant and submitted a revised plan entitled, “ NO1-1 and NO1-2, 68 Mohawk Street,”  7/21/10, last date revised. He explained to the Commission that the Applicant has re-designed the layout of the proposed project site to address the concerns of the Commission. The size of the proposed compound has been reduced from 70’ x 70’ to 40’ x 70.’ The Applicant is proposing to install an outside equipment cabinet on a steel grated platform with concrete piers as an alternative to the equipment shelter that was proposed on the previous plan. The dimensions are 12’ x 20’ for the proposed steel grated platform. The revised size of the compound is being proposed by the Applicant to reduce the impact to the wetland resource areas of the proposed project site and to reduce the impervious area of the site. The revised plan also includes provisions for potential carriers with the expectation that they will also be on steel grated platforms with concrete piers.
Hank and Meredith indicated that they thought the platform constituted a “permanent structure,” therefore, the size of the proposed grated platform would be 240 square foot structure.  
Attorney Ed Pare indicated that unless they moved the proposed facility close to Mohawk Street, they might not be in compliance with the Commission’s rules and regulations. He does not believe that the proposed platform represents a structure.
Leo Garneau indicated that perhaps each cabinet could be installed on a concrete pad individually, or together, which would change the amount of the square footage to be less than 120 square feet. This idea was presented to the Commission to see if it would be an acceptable alternative for the Applicant to pursue.
The Applicant is meeting again with the Zoning Board of Appeals on September 22, 2010.
Meredith and Hank explained that they would still prefer to see the proposed facility moved further away from the wetland areas of the proposed project site.
Hank called for a motion to continue the hearing until September 2, 2010 at 8:00 p.m.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

A Request for Determination of Applicability Hearing continuance filed by Eugene Chitvanni and Steve Reid for the proposed site grading associated with the construction of a single-family home at 36 Mont Fern Ave:

The Applicants appeared before the Commission and requested a hearing continuance for their proposed project. The Applicants explained to the Commission that the engineer for the proposed project has not yet completed delineating the proposed Conservation Restriction Line on a revised plan to submit to the Commission.
Hank called for a motion to continue the hearing until further notified by the Applicant.
Meredith deCarbonnel moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

An Abbreviated Notice of Intent Hearing continuance filed by Igor Tsinman for the proposed covered porch, rear addition, sunroom, and deck, within the 100’ Buffer Zone at 6 Arboro Drive,
DEP # SE-280-0518:

Igor Tsinman appeared before the Commission and submitted the green abutter cards and a proposed plan entitled, “Plan to Accompany Notice of Intent # 6 Arboro Drive, Sharon, MA”. Dated 3/17/10.
The Applicant explained the Zoning Board of Appeals process that has been approved.  
The Commission requested the Applicant to notify the Conservation Administrator prior to the start of the proposed project for inspection of erosion control measures.
Hank called for a motion to close the hearing and to issue the Order of Conditions to the Applicant per submitted plan.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

A Request for Determination of Applicability Public Hearing filed by Linda Valentin for the proposed improvements and repairs to an existing office building and associated site work, some of which lies within the 100’Buffer Zone at 121 Lakeview Street:

The Applicant appeared before the Commission and submitted a proposed plan entitled, “Septic System Design Site Plan in Sharon, MA.” Dated August 1, 2010. The Applicant explained to the Commission that the proposed repairs and improvements for the former administration building are needed to change the use of the building from a business to a Montessori School for girls that will be comprised of 5 classrooms. The proposed building improvements will increase the square footage from 2,500 to 3,800 square feet. The proposed new septic system is in compliance with the Board of Health regulations.
The Conservation Administrator previously met at the site with the Applicant/Representatives to review the proposed work within the 100’ Buffer Zone. Based on the results of his inspection, he recommended that the Applicant submit a filing with the Commission for the proposed work that slightly encroaches on the edge of the 100' Buffer Zone of the project site.
The Commission agreed to close the hearing and issue a Negative Determination to the Applicant per submitted plan. The Commission requested the Applicant to contact the Conservation Administrator prior to construction of the proposed project for inspection of erosion control measures.
Hank called for a motion to close the hearing and to issue a Negative Determination to the Applicant.
Elizabeth McGrath moved. Meredith deCarbonnel seconded. Voted. Unanimous. 4-0-0.

The Commission reviewed correspondence received regarding 30 Highland Ave.
